General Terms

Liability & Disclaimers

No Liability Post-Sale: Martini Livestock & Sheepdogs is not liable for injury, illness, or death occurring after the animal leaves our premises.

Visitor Safety: Visitors to the farm are responsible for their own safety and must follow all instructions given.

Children: Children must be supervised at all times when visiting the farm.

Working Environment: Park Hills Farm is a working farm - visitors must be aware of potential hazards.

Insurance: We recommend buyers obtain appropriate insurance for their animals.

Privacy & Data Protection

Data Collection: We collect personal information necessary to complete sales and maintain records.

Data Use: Your information will be used for sales records, registration purposes, and ongoing support.

Data Storage: All customer data is stored securely and in compliance with UK data protection laws.

Marketing: We may contact you with updates about available stock unless you opt out.

Third Parties: Your data will not be sold or shared with third parties except where required by law or breed registries.

Disputes & Resolution

Good Faith: We aim to resolve any disputes or concerns in good faith and with open communication.

Contact First: If any issues arise, please contact us immediately so we can work toward a resolution.

Mediation: In the event of a dispute, we encourage mediation before pursuing legal action.

Governing Law: These terms are governed by the laws of England and Wales.

Jurisdiction: Any legal proceedings will be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to Terms

Right to Modify: We reserve the right to modify these terms and conditions at any time.

Notification: Significant changes will be communicated to customers and posted on our website.

Existing Contracts: Changes to terms do not affect existing signed contracts.

Livestock Purchase Terms

General Livestock Terms

As Described: All livestock are sold as described and in good health at time of sale.

Viewing Encouraged: Buyers are encouraged to view livestock in person before purchase.

MV-Accredited: Our flock is MV-accredited and all necessary health documentation will be provided.

Movement Documentation: All required movement licenses and documentation will be completed for livestock sales.

Registration Papers: Pedigree sheep will be sold with registration papers from the relevant breed society.

Livestock Payment & Collection

Payment Terms: Payment in full required before collection unless otherwise agreed in writing.

Collection: Livestock must be collected within agreed timeframe after sale.

Transport: Buyer is responsible for arranging appropriate transport and livestock trailer.

Loading Facilities: We have suitable handling and loading facilities available.

Risk Transfer: Risk passes to buyer upon loading of livestock.

Health & Biosecurity

Health Status: All livestock are from our MV-accredited flock with appropriate health screening.

Biosecurity: Buyers must adhere to biosecurity protocols when collecting livestock.

Isolation Period: We recommend a standard isolation period when introducing new stock to your flock.

Health Records: Full health and vaccination records will be provided with livestock.

Veterinary Examination: Livestock have been examined by our vet and are certified fit for sale.

Working Dog Purchase Terms

Purchase Contract

Written Agreement: All dog sales are subject to a written purchase contract signed by both parties.

Contract Contents: The contract will include dog details, price, health information, breeding restrictions, and terms of sale.

Binding Agreement: Once signed, the contract is legally binding on both buyer and seller.

Contract Provided: A copy of the signed contract will be provided to the buyer at the time of purchase.

Payment Terms

Deposit: A non-refundable deposit may be required to reserve a puppy or dog (typically £200-£500).

Full Payment: Full payment is required before collection of the dog unless otherwise agreed in writing.

Payment Methods: We accept bank transfer, cash, or cheque (cheque must clear before collection).

Price Includes: First vaccinations, microchipping, worming, ISDS/KC registration (where applicable), and health check.

Cancellation by Buyer: Deposits are non-refundable if the buyer cancels after reservation.

Health Guarantee

Health at Sale: All dogs are guaranteed to be in good health at the time of sale, verified by veterinary examination.

Veterinary Check: Buyers are encouraged to have the dog examined by their own vet within 48 hours of purchase.

Health Issues: If a serious hereditary health issue is discovered within 12 months, we will work with the buyer to find a fair resolution.

DNA Testing: Breeding dogs are DNA tested for common hereditary conditions (CEA, TNS, CL, IGS).

Exclusions: Health guarantee does not cover injuries, illnesses caused by negligence, or conditions arising from improper care.

Veterinary Records: Full vaccination and health records will be provided at time of sale.

Breeding Rights & Endorsements

Breeding Restrictions: Some dogs may be sold with breeding endorsements or restrictions in place.

Written Permission: Dogs sold on breeding restrictions require written permission from Martini Livestock & Sheepdogs before breeding.

Full Breeding Rights: Dogs sold with full breeding rights may be bred without restriction, but breeder must be informed of litters.

Endorsement Removal: Breeding endorsements may be removed once certain conditions are met (e.g., health testing, working qualifications).

Stud Service: Males sold for stud must not be used at stud without written permission if breeding restrictions apply.

Buyer Responsibilities

Suitable Home: Buyer must provide a suitable, safe, and appropriate home environment for a working dog.

Veterinary Care: Buyer must provide appropriate veterinary care, including annual vaccinations and routine health checks.

Training & Exercise: Working dogs require regular training, exercise, and mental stimulation.

Feeding & Nutrition: Buyer must provide appropriate nutrition and feeding regime suitable for a working dog.

Updates: We appreciate updates on the dog's progress and development, though this is not mandatory.

Right of Refusal: We reserve the right to refuse sale to anyone we believe cannot provide suitable care.

Returns & Rehoming Policy

First Refusal: If the buyer can no longer keep the dog, Martini Livestock & Sheepdogs must be given first refusal to take the dog back.

No Guarantee of Return: While we will always try to help, we cannot guarantee to take every dog back due to space and circumstances.

Rehoming Assistance: We will assist in finding a suitable new home if the dog cannot be returned to us.

No Resale Without Permission: Dogs should not be sold or rehomed without first contacting Martini Livestock & Sheepdogs.

Rescue/Shelter: Dogs must not be surrendered to rescue centres or shelters without first contacting us.

Collection & Transport

Collection: Dogs must be collected from Park Hills Farm unless alternative arrangements are made.

Transport: Local delivery may be available for an additional fee - contact us for details.

Secure Transport: Buyer must provide secure and appropriate transport for the dog (crate or travel harness recommended).

Collection Timing: Collection times must be arranged in advance - we cannot accommodate unannounced visitors.

Risk Transfer: Risk passes to the buyer upon collection of the dog.
